TERMS & CONDITIONS
- Introduction
- No variation of these terms and conditions shall be applicable unless explicitly agreed in writing by Aiden Lumb.
- Your rights and obligations in relation to bookings made with me are governed by these terms and conditions, as are my own.
- You will be asked to provide your express agreement and understanding of these terms and conditions as part of your booking.
- These terms and conditions do not affect your statutory rights as a consumer.
- Interpretation
- In these terms and conditions:
- “me”, refers to Aiden Lumb, trading as Peaks of Adventure™ (“my”, “mine”, “myself” etc. should also be construed accordingly);
- “you” refers to a client or prospective client under these terms and conditions (“your”, “yours”, “yourself” etc. should also be construed accordingly); and
- “booking” refers to a booking which may be made by you under these terms and conditions.
- Booking Conditions
- Bookings for activities are made only upon the receipt of full payment, satisfactory completion of the participant consent form and following written confirmation via email.
- Places for activities are reserved only upon receipt of a completed participant consent form and full payment. Upon receipt of payment your place will be reserved and this will be confirmed via email.
- Places can only be reserved by means of a completed participant consent form and receipt of payment in full.
- Payment methods: accepted forms of payment are electronic bank transfers (BACS). At my discretion, I may choose to accept other forms of payment and if applicable, I will communicate this with you directly.
- Once the receipt of a completed participant consent form has been accepted in writing, the person(s) named on the booking form will enter into a binding contract with me on the basis of these terms and conditions.
- The total balance of the activity fee is payable a minimum of 14 days prior to the commencement of the activity. In the event that the balance is not paid before this time, I have the discretion to treat the booking as a cancellation and may choose to re-sell the course date and time.
- Full payment made within 14 days of the commencement of the activity is required to confirm your place.
- Activity fees will be quoted on a per person basis.
- Cancellation & Refund Policy
- All cancellations and amendments must be made in writing.
- Should you choose to cancel your booking, remittance by way of a full or partial refund, may be made to you by me, but this is dependent on the reason and is entirely at my discretion.
- In the event of you failing to arrive at the correct place in time for your activity, your place on the activity may be lost. I am unable to issue refunds for you failing to arrive in time for an activity, regardless of the reason. Please be aware that I am also under no obligation to reschedule the activity with you.
- In the event of you missing an activity due to you making an error in booking, I am unable to issue a refund or reschedule the activity with you.
- In the event that you arrive at an activity ill-equipped, where this poses a risk to your personal safety, I reserve the right to turn you away and you will not be offered a refund.
- If I cancel your booking you will receive a full refund. However, I cannot accept any liability for any other losses incurred by you.
- Client Suitability
- You will need to be medically fit and ready to participate in the activity and it is your responsibility to ensure this. You will likely be physically active for the best part of the activity.
- There is no overall weight or height restriction however, participation for certain activities is dependent upon the correct fitting of safety and personal protective equipment. You should also be physically fit and able to participate in the activity.
- Certain medical conditions/injuries may impact your ability to participate in some activities. Please speak with me directly if you think you may have a condition or impediment that will be an issue. I will endeavour make reasonable adjustments as much as is reasonably practicable, but please be aware that not all of the activities are suitable for everyone. Please ensure that you do this prior to making a booking for an activity.
- Liability & Risk
- The activities I deliver are not without inherent risk. Although I will make every effort to minimise these risks, I cannot remove them entirely. As such, in making a booking, you must accept these risks as part of your chosen activity, as outlined in the disclaimer section of the participant consent form.
- I will only accept liability for injury to a client where negligence on my part is proven.
- Loss & Damage
- Any loss or damage caused to the equipment I supply will be invoiced to the person in question.
- If you are using your own equipment, please ensure it is fit for use prior to attending an activity. In the event that I deem your equipment unsafe or not fit for purpose, I will do one of two things:
- Where available, supply you with appropriate equipment as a replacement;
- Ask you to leave the activity
- I cannot be held responsible for loss or damage to your personal property whilst attending an activity.
- Complaints Procedure
- If whilst attending an activity, you should feel there is cause for complaint, the matter should be discussed with me directly during the activity. Should you wish to complain after the activity, then this should be made in writing within 28 days. I am under no obligation to pursue any complaint made after this period.
